Engineer who falsely certified that PSF facilities were built according to MDNR-approved plans surrenders license

Jefferson City, Mo. — An engineer who falsely certified that construction on manure-handling systems at 15 Premium Standard Farms facilities in northern Missouri was done in accordance with plans and specifications approved by the Department of Natural Resources has permanently surrendered his Missouri license to act as a professional engineer, Attorney General Jay Nixon announced today.

Nixon's office represented the Missouri Board of Architects, Professional Engineers and Land Surveyors in seeking the disciplining of the professional licenses of Gerald W. Hollander and the engineering firm he works for, WHKS & Co. The firm is based in Mason City, Iowa.

Beginning in 1993, Hollander prepared engineering drawings and calculations for the design and construction of manure-handling systems at the PSF facilities. Those drawings and calculations were approved by MDNR prior to construction. After construction was completed, Hollander certified to MDNR that it was done in accordance with the approved plans and specifications, when in fact, there had been unapproved deviations.

Nixon said that MDNR relied on Hollander's certifications and issued permits allowing the giant factory farms to begin operating. Following the permitting based his certifications, several hog manure spills repeatedly polluted area streams and killed thousands of fish.

"These facilities handle the waste from millions of hogs every year, and it is imperative that all construction be done in a manner that protects human health and the environment," Nixon said. "It was irresponsible of Mr. Hollander, when entrusted with a great deal of responsibility in this area, to represent that the construction had been carried out as approved. As a result, he is paying the price by having to give up his professional license in Missouri."

The surrender of Hollander's license was included as part of a joint agreement filed with the Administrative Hearing Commission by Nixon, the Board of Architects, Professional Engineers and Land Surveyors, Hollander and WHKS. The agreement also places WHKS' certificate of authority to practice engineering in Missouri placed on probation for five years. Nixon added that the construction deviations outlined in the complaint against Hollander had been addressed and corrected as needed.
